Welcome to BULLCLOUD (hereinafter referred to as “we,” “us,” or “the Platform”). These services are operated by BullCloud Network Technology Ltd, registered and based in Denver, Colorado, USA. By accessing or using our services, you agree to be bound by the full terms of this Agreement.
1. Description of Services
BULLCLOUD provides high-quality information technology infrastructure services, including but not limited to:

Cloud Resources: Virtual Private Servers (VPS), Dedicated Servers.

Network Resources: Bandwidth, Static IP addresses, and network optimization.

Storage & Computing: Data storage and cloud computing instances. Specific service details are subject to the parameters selected during the ordering process.
2. Account Registration and Security

Information Accuracy: Users must provide true, accurate, and complete information during registration.

Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials. All activities performed under your account are deemed your own.

Loss of Access: BULLCLOUD is not liable for any loss resulting from unauthorized access to your account due to your failure to secure your credentials.

Suspension: We reserve the right to freeze or terminate accounts found to be in violation of our policies or displaying abnormal behavior without prior notice.
3. Fees and Payment

Pre-paid Model: All services are provided on a pre-paid basis unless otherwise agreed in writing.

Renewal: Users must renew services before the expiration date. Failure to pay will lead to service suspension. If payment is not received within the grace period (typically 24–72 hours), data will be permanently deleted and resources released.

Refund Policy: Once services are provisioned and delivered, payments are generally non-refundable.

Payment Disputes: Any fraudulent activity or unauthorized Chargebacks will result in the immediate and permanent termination of all associated services and potential legal action.
4. Acceptable Use Policy (AUP)
Users agree not to use BULLCLOUD services for the following prohibited activities:

Illegal Activities: Fraud, gambling, money laundering, or any activity violating US or local laws.

Network Attacks: DDoS attacks, port scanning, brute force attacks, or distributing malware/viruses.

Spamming: Sending unsolicited bulk emails (SPAM).
-
Infringement: Hosting content that infringes on third-party intellectual property rights.
-
Prohibited Content: Hosting child pornography, extreme violence, or any content prohibited by law.
Consequences: Violation of the AUP may result in immediate termination of service and data deletion without refund.
5. Resource Usage Limits

Fair Use: Users must not consistently overload shared resources (CPU, I/O) to the detriment of other users.

Bandwidth Abuse: Excessive or abnormal traffic patterns that disrupt network stability are prohibited.
6. Service Availability & Limitation of Liability

SLA: While we strive for high availability, we do not guarantee 100% uptime or zero latency.

Force Majeure: We are not liable for service interruptions caused by:

Upstream provider outages or backbone network failures.
-
Force majeure events (natural disasters, war, government actions).
-
Third-party attacks (e.g., massive DDoS).

7. Data and Backup

User Responsibility: Data backup is the sole responsibility of the user. BULLCLOUD is not liable for data loss under any circumstances.

Redundancy: We strongly recommend that users maintain off-site, offline backups of their critical data.
8. Governing Law and Dispute Resolution

Jurisdiction: This Agreement is governed by the laws of the State of Colorado, USA.

Dispute Resolution: Any disputes shall first be resolved through friendly negotiation. If negotiation fails, disputes shall be submitted to the courts of competent jurisdiction in the State of Colorado.
